TPS to Employment-Based Green Card: How to Identify Employment-Based Options for TPS Recipients

 

As news has surfaced that the Trump Administration is terminating TPS for Nicaragua and Haiti, the need for all TPS holders to explore all immigration options has never been greater. Recent decisions in the 9th and 6th Circuits have created potential pathways for TPS applicants to obtain permanent residency through employment. Non-profit attorneys/paralegals and the private bar who work with the TPS population are encouraged to attend the training to help identify when a TPS recipient may be eligible for an employment-based green card.

 

Topics covered include:

  • How Ramirez v. Brown, the recent 9thCircuit case finding that TPS counts as an “admission,” creates possibilities for some TPS recipients to obtain LPR status through an employer.
  • Assessing inadmissibility, the requisite waivers, and eligibility for employment-based Adjustment of Status, including a summary of 245(k).
  • Overview of the PERM labor certification process for skilled worker and professional categories, including a comprehensive summary of current processing times.

 

Emily Wilson is an Associate Attorney at Becker & Lee LLP. Emily works primarily in employment-based immigration and focuses on PERM labor certification and Adjustment of Status applications. Emily also has experience with family-based immigration, non-immigrant visas, asylum and naturalization. She is proficient in Spanish.

 

Camiel Becker is founding partner at Becker & Lee LLP. He is a certified as a specialist in immigration and nationality law by the California Board of Legal specialization. He represents a number of companies and individuals in the employment-based green card and non-immigrant visa processes. As a US Fulbright scholar, Camiel conducted research on gangs and street children in El Salvador. He is fluent in Spanish and has worked for more than ten years with Central American clients, including those with TPS.
